Heady Club DC – Terms of Use

1. Acceptance of Terms
The website located at www.headyclubdc.com (the “Site”) and all services offered through it (the “Services”) are owned and operated by Heady Club DC Weed Delivery and Marijuana Dispensary (“Heady Club DC,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site and Services. By accessing or using the Site or Services, you expressly agree to these Terms. If you do not agree, do not use the Site or Services. If you are accepting these Terms on behalf of an entity, you represent that you are authorized to bind that entity.

2. Eligibility & Account Registration

• Age & Location: You must be at least 21 years old and physically located within the District of Columbia to access or purchase cannabis products.

3. Changes to Terms
We may modify these Terms at any time by posting updated Terms on the Site and updating the “Effective Date.” Continued use after changes constitutes acceptance.

4. License Grant & Restrictions

• License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for your personal, noncommercial use.

• Restrictions: You agree not to (a) reproduce, distribute, or create derivative works of the Site; (b) reverse engineer any part of the Services; (c) use the Site to build a competing service; (d) scrape, mine, or harvest data from the Site; or (e) violate any applicable law in using the Site.

5. Intellectual Property
All content on the Site—including text, graphics, logos, images, software, and trademarks—is owned or licensed by Heady Club DC and protected by U.S. and international law. Nothing in these Terms transfers ownership of any intellectual property to you.

6. User Conduct & Acceptable Use
You agree not to:

• Post or transmit unlawful, abusive, defamatory, or infringing content.

• Interfere with the Site’s operation or introduce malicious code.

• Impersonate any person or entity or misrepresent your affiliation.

• Use automated scripts or bots to access the Services without our consent.

Heady Club DC reserves the right to monitor, suspend, or terminate your access for any conduct deemed harmful or in violation of these Terms.

7. User Content

• Definition: “User Content” is any material you submit or post on the Site (reviews, comments, photos).

• Responsibility: You alone are responsible for your User Content. You represent that you have all rights necessary to upload and license your User Content.

• License to Us: By posting User Content, you grant Heady Club DC an irrevocable, royalty-free, worldwide license to use, reproduce, modify, and display that content in connection with the Services.

8. Disclaimers & Medical Information

• No Medical Advice: Information on the Site is for educational purposes only and is not medical or legal advice. Always consult a qualified professional before using cannabis.

• Federal Law Acknowledgment: Cannabis remains illegal under U.S. federal law. By using the Site, you acknowledge compliance with DC law and assume all federal risks.

9. Third-Party Links & Interactions
The Site may include links to third-party sites or services, including dispensary menus or deals. Heady Club DC does not endorse and is not responsible for third-party content, products, or services.

10. Indemnification
You agree to indemnify and hold harmless Heady Club DC and its officers, employees, and agents from any claims, liabilities, or expenses (including attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Heady Club DC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

12. Termination
We may suspend or terminate your access at any time for any reason. Sections 4, 5, 7, 8, 10, 11, and 13–15 will survive termination.

13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the District of Columbia without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Washington, DC.

14. Arbitration & Class Action Waiver
You and Heady Club DC agree to resolve disputes by binding arbitration under the American Arbitration Association rules. You waive any right to a jury trial or to participate in a class action.
